2. Description of Service

• Document medication incidents, near misses, and safety events in compliance with the Ontario College of Pharmacists (OCP) Assurance and Improvement in Medication Safety (AIMS) program (Ontario) and equivalent medication-safety programs of provincial and territorial pharmacy regulators.
• Submit de-identified incident data to the ISMP Canada National Incident Data Repository (NIDR) once the pharmacy has executed a Data Sharing and Participation Agreement (DSPA) directly with ISMP Canada.
• Advertise and promote local pharmacies by language, service and features.
• Generate reports and analytics for continuous quality improvement (CQI) activities.
• Manage pharmacy documents, standard operating procedures, and safety policies.
• Maintain compliance records for regulatory purposes.
• All data processed by Ontario Pharmacy Finder is stored exclusively in Supabase Inc, located in Canada. Incident data is submitted to the ISMP Canada NIDR daily, after which the NIDR serves as the long-term repository governed by ISMP Canada's own retention policies. However, incident reports are also retained in our transactional database for 3 years from the date of creation to facilitate staff review and quality improvement meetings, after which they are permanently deleted by an automated cleanup process.

3. Account Registration and Eligibility

• Be a licensed pharmacy operating in Ontario, or an authorized representative thereof;
• Provide a valid pharmacy registration or accreditation number issued by the OCP in Ontario during registration;
• Provide a valid professional email address and phone number for account communications;
• Provide accurate, current, and complete registration information including the pharmacy's address, phone, and fax numbers;
• Maintain the security of your account credentials;
• Promptly notify Ontario Pharmacy Finder of any unauthorized access to your account. Each regulated member who accesses the Service must have their own individual user account. Account sharing is prohibited and may constitute a violation of the standards of practice of the user's provincial or territorial pharmacy regulator.

4. Acceptable Use and Incident Reporting Attestation

• Use the Service to store patient-identifying information, including patient names, health card numbers, or addresses, in free-text fields. Prior to submitting an incident report, users must affirmatively confirm and attest that they have reviewed their free-text entries and that they do not contain personally identifiable patient information;
• Attempt to circumvent, disable, or interfere with any security features of the Service;
• Use the Service to transmit malware, viruses, or other harmful code;
• Access or attempt to access another pharmacy's data;
• Use automated tools, bots, or scripts to access the Service except as explicitly authorized;
• Sublicense, resell, or redistribute access to the Service;
• Use the Service in violation of any applicable law, regulation, or professional standard;
• Modify, sell, resell, reproduce, copy or otherwise exploit Ontario Pharmacy Finder.
• Furthermore, Ontario Pharmacy Finder does not send incident text to generative large-language-model APIs (such as OpenAI, Anthropic, or Google Gemini) and does not train any model on customer data.

5. Subscription and Billing

• Silver Plan ($0 / Free Starter Profile): Designed for basic directory discovery. Includes display of basic pharmacy information, phone number, physical address, and operating hours.
• Gold Plan ($50 / year): Includes all Silver features plus an advanced pharmacy profile display with enhanced searchability filtering (by languages spoken, clinical services offered, and specialty services and features).
• Diamond Plan ($150 / year): Includes all Gold features plus full access to the Medication Safety Module (including ISMP Canada MSSA access, NIDR incident reporting, secure incident logs, CQI dashboard, and in-store safety assessment workflows).
• Payment Processing: All payments are collected and processed directly by Stripe Payments Canada Ltd.. Ontario Pharmacy Finder does not receive or store your full credit card number or banking information.
• Automatic Renewal: Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
• Cancellation and Refunds: You may stop your subscription by cancelling it (which retains access until the end of your billing period with no refund) or deleting your account (which cancels immediately and permanently removes your data within 60 days, with no refund).

8. Limitation of Liability

• Ontario Pharmacy Finder provides the Service "as is" and "as available" without warranties of any kind.
• Ontario Pharmacy Finder shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service.
• Ontario Pharmacy Finder's total aggregate liability arising out of or in connection with these Terms or the Service shall not exceed the total fees paid by you to us in the twelve (12) months preceding the event giving rise to the claim.
• Ontario Pharmacy Finder does not guarantee that NIDR submissions will be accepted by ISMP Canada, as acceptance is subject to ISMP Canada's own systems and policies.
• Consumer Protection Carve-outs: Nothing in this section limits rights under the Ontario Consumer Protection Act, 2002, (including liability for intentional fault, gross fault, or bodily/moral injury) where applicable.

• your violation of these Terms;
• your violation of any applicable law or regulation; or
• any data or content you submit to the Service.
